These Terms of Service govern your access to and use of SiteServing's virtual machine hosting, reseller hosting, and related services. By creating an account or using our services, you agree to these terms. Section 5 is our Acceptable Use Policy, incorporated here in full.
This agreement is between you and SiteServing Hosting ("SiteServing," "we," "us") and covers every service we offer, including VPS hosting on XEN, KVM, and OpenVZ, reseller hosting, migrations, and the SiteServing Client Portal. If you use our services on behalf of a company, you're confirming you have the authority to bind that company to these terms.
We may update these terms as our services evolve. For material changes, we'll post a notice on this page and, where practical, email the address on your account at least 30 days before the change takes effect. Continuing to use SiteServing after a change takes effect means you accept the updated terms.
You must be at least 18 years old to open a SiteServing account. You agree to provide accurate contact and billing information, keep it current, and secure your account credentials, including any API keys and SSH access you generate.
SiteServing provides virtual private servers on XEN, KVM, and OpenVZ hypervisors, reseller hosting accounts, and a free, human-assisted migration service for customers switching from another host. Specific plan features, resource allocations, and infrastructure regions are described on our website and in your order confirmation, and form part of this agreement.
Because our services run on shared physical infrastructure (except where you've purchased dedicated resources), we size plans conservatively so that no single account can degrade performance for others. Section 9 covers this in more detail.
You retain ownership of everything you upload, install, or run on your server ("Your Content"). You're solely responsible for its legality, its security, and for keeping your own copies of anything irreplaceable.
You grant SiteServing a limited license to host, cache, back up, and transmit Your Content solely as needed to provide the services, troubleshoot issues you report, and comply with law. We don't inspect Your Content proactively and won't access it except to maintain the platform, respond to a support request you open, investigate a suspected Acceptable Use violation, or comply with a valid legal request.
This section applies to every SiteServing account, including reseller sub-accounts. Violating it may result in content removal, suspension, or termination, as described below.
Shared VPS plans are sized for typical web, application, and small database workloads. Sustained CPU, I/O, or bandwidth usage that measurably affects other customers on the same host is a violation, even if every individual process is otherwise legal. See Section 9 for plan-specific thresholds.
We enforce this policy at our discretion, guided by severity and intent. Where practical, we'll notify you and give you a chance to fix the issue before taking action. For active abuse, ongoing harm to third parties, or legal exposure to SiteServing, we may suspend the affected service immediately and notify you afterward.
To report a suspected violation of this policy, including a copyright or trademark claim, contact our abuse team through the Client Portal support channel.
If you resell SiteServing hosting to your own clients, you're responsible for your clients' compliance with these terms, including the Acceptable Use Policy, and for providing them with first-line support. SiteServing may still act directly against an individual client account, including suspension, if it's necessary to protect our network or other customers, and we'll notify you when we do.
Reselling on a non-reseller VPS plan, including running paid hosting for third parties, isn't permitted; if that's your use case, move to a reseller plan and we'll prorate the difference.
New VPS and reseller hosting accounts come with a 30-day money-back guarantee on the hosting fee. Domain registrations, SSL certificates, licensed control panels, and setup fees are non-refundable once purchased, since we incur those costs immediately on your behalf.
You can cancel anytime from the Client Portal. Cancelling stops future renewals; it doesn't retroactively refund a cycle that's already outside the 30-day window. We don't charge early termination fees.
Each plan (Node.S, Node.M, Node.L, Node.XL, and their reseller equivalents) lists dedicated vCPU, RAM, NVMe storage, and bandwidth allocations, which are yours to use in full. On shared hypervisor nodes, sustained usage above your plan's allocation may be throttled to protect other tenants; on VPS plans with guaranteed resources, this doesn't apply to the resources you've purchased.
We don't cap inode or file counts artificially, but extremely high file counts (millions of small files) can affect backup performance, and we may ask you to consolidate or archive them.
SiteServing performs routine backups of shared and reseller hosting accounts as a courtesy, not a guarantee. Because our VPS plans include full root access, you're in control of what runs on the server, and you're responsible for maintaining your own backup strategy for anything you can't afford to lose.
We recommend automated off-server backups for production workloads. If your account is suspended for non-payment or an Acceptable Use violation, we retain data for 15 days before deletion; after that, it can't be recovered.
We target 99.9% network and power uptime across our infrastructure, including the IBX DC11, IBX LA04, and IBX DU01 facilities. Scheduled maintenance is announced in advance through the Client Portal and, where it may cause downtime, by email. This target is an operational goal, not a guaranteed service credit unless you have a separate SLA agreement with us.
SiteServing's name, logo, website, and documentation are our property or licensed to us, and this agreement doesn't transfer any of it to you. If you believe content hosted on our network infringes your copyright or trademark, submit a notice through the Client Portal with enough detail for us to locate and evaluate it; we'll respond consistent with applicable law.
Some features rely on third-party software or providers, such as control panel licenses, CDN partners, or email delivery services. Your use of those features may also be subject to that provider's terms, and we aren't responsible for their availability, security, or changes to their pricing or features.
Except as expressly stated in these terms or a separate SLA, our services are provided "as is" and "as available." We don't warrant that they'll be uninterrupted, error-free, or fully secure against every possible threat, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent the law allows.
To the extent permitted by law, SiteServing's total liability arising from these terms or your use of the services is limited to the amount you paid us for the affected service in the three months before the claim arose. Neither party is liable for indirect, incidental, or consequential damages, including lost profits or lost data, even if advised of the possibility.
You agree to defend and indemnify SiteServing against third-party claims and reasonable expenses arising from Your Content, your violation of these terms, or your violation of a law or another party's rights.
You may terminate your account at any time through the Client Portal. We may suspend or terminate service for non-payment, an Acceptable Use violation, or a legal obligation, and will generally give notice first unless the risk of harm requires acting immediately. On termination, Section 10's data retention timeline applies.
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing a claim, we both agree to try to resolve it informally by contacting the other party in writing and allowing 30 days to respond. If that doesn't resolve things, disputes will be handled in the state or federal courts located in Texas, and both parties consent to that venue.
